Hello folks

 Please find attached the presentation  I  made  on behalf of the CKC  yesterday to the Ontario  Legislative  Committee at public hearings.   Ontario is in the process of considering Amendments to it's SPCA Act - amendments that would provide among other things the power of entry to properties without a search warrant under particular conditions, and the assignment of the full powers of a police officer to all SPCA investigators. 

 Cathy Prothro and I  (two members of the CKC's Responsible Dog Ownership Committee) put together  the CKC presentation this week after the CKC Directors were convinced that a CKC presentation needed to be made.   Since we spoke at 4:00 we were able to listen to the afternoon's  presenters.  Ahead of us were the Burr Foundation, the Hervieux family from North Bay (who, I believe, are CKC members), a Toronto woman of Russian background with a German Shepherd dog, Diana Shore (farm background and a member of a citizen's land owning group who are lobbyists focused on this government's activities), the Burlington Humane Society and the Ontario Federation of Agriculture.  The morning sessions were the Canadian Coalition for Farm Animals, several private citizens, the Humane society of Canada's Chairman, Canadian Legal Accountability Watch, Canadian Association of Zoos and Aquariums and Sunny Reuter (again, a CKC member from whom many of us hear on a regular basis).  Many of the private presentations were tough to hear.   The Hervieux family had horses confiscated (and returned several years later with no charges ever laid against them).  The Korchounov woman is a mother of two young children who had the their family pet forcibly seized from their home with the children present (again to have it returned two days later with no charges laid) because the 13 year old dog had an eye problem that was being treated by a Vet but had a complaint laid about it by a neighbour).  You will be able to read the details in Hansard but believe me it was not an easy thing to sit and listen to these very emotional folks who certainly are not people who ever would have seen themselves presenting to a Provincial government.   

 There were only two Opposition MPP's in attendance -  PC  Garfield Dunlop and Cheri DiNovo from the NDP.   Liberal MPP David Zimmer is the committee chair.  Mr Zimmer has served on the OSPCA board and was given an award last year by the World Society for the Protection of Animals. 

 The history of this Amendment appears to be that it started as an Opposition interest but Mr Zimmer brought it forward as a Private Member's Bill.  It is now in public hearings  

 As you can see from our presentation, the proposed amendments are troublesome and will be highly problematic to Ontario citizens who run afoul of the SPCA.  Their powers are being increased - with full powers of a police officer (including warrantless search and seizure and no redress mechanism in several instances -  in very subjective situations,  they will simply  have the authority to take  your animal  and you have no  redress mechanism should these Amendments pass ).  The  SPCA is also self policing with no independent redress available.  This Amendment would also do away with all Humane Societies in the Province since they would no longer be able to call themselves Humane Societies .

 The hearings move to London and then to Ottawa culminating with Friday hearings in Toronto. 

 We did our best.  The CKC presented and it was a solid presentation - we are likely one of the few they will hear from  without an axe to grind with the OSPCA.  There are a lot of humane society folks in attendance in the galleries and they are hopping mad so they may have some clout at the grassroots level.  Some MPP's are likely to have been involved with the Humane Societies at some stage so that is the one area that may not stick - but again, who knows. 

 Ontario becomes less and less welcoming to dogs, their owners and to dog breeders.  Let's hope this wasn't all a charade and that  the Liberal strong majority may actually have listened to some of these folks.  The fall sitting will tell the story.

Important Change to CKC Breeder Code of Practice
 
The Board at the regular June meeting considered and approved the following amendment to the Code of Practice for CKC Member Breeders: Section III, General Responsibilities, subsection (g). 

With the additional requirement regarding pet store sales added, the new policy statement now reads as per the changes below. As with any other policy subject to associated disciplinary action it is important for the membership to note the addition made.
   
CKC RDOG'S Day Coming Soon!
50 Years 
On Saturday June 14, 2008, at the CKC Annual General Meeting, the Canadian Kennel Club announced the first ever National Responsible Dog Ownership Day* to be held this September.  Events will begin Saturday, September 20, 2008, and culminate in an RDOG Walk across Canada on RDOG'S DAY Saturday, September 27. "Responsible Dog Ownership Groups" (RDOG'S) will rally across Canada in neighbourhoods large and small and collectively promote, educate and enlighten.

CKC Foundation Board Appointed
 
At the inaugural meeting of the CKC Foundation members held in conjunction with the CKC Board meetings in June, the appointment of CKC Foundation's first Board members was made. 
FCI Recap and Status Report
 
FCISince being notified on November 24, 2006, of the decision by the General Committee of the Fédération Cynologique Internationale (FCI) to sanction the CKC there have been numerous discussions, meetings and correspondence exchanges.
 
Request for Proposal - CKC Charity Event
 
The Canadian Kennel Club and the CKC Charity Event Committee is inviting bids for the provision of set-up and clean-up services for a three-day event to be held in Tillsonburg, Ontario in November 2008.
 

CKC Life Member Celebrates 100th Year!

 
The Canadian Kennel Club would like to congratulate CKC Life Member, Dorothy Grosart, on her centennial year, as of May 1, 2008. Dorothy joined the CKC on January 1, 1960 and is currently in her 49th year of membership with the Club.

Air Canada Summer Embargo Reinstated
 
As part of our continued dialogue with Air Canada, CKC recently contacted Air Canada officials regarding the reinstatement of the summer embargo, from June 20 until September 10, 2008.

EFFECTIVE IMMEDIATELY - FCI LIFTS BAN ON CKC JUDGES
 
At the recent FCI General Committee meeting held on April 1, 2, 2008, the decision was made to lift a ban imposed on CKC judges since late 2007. CKC Chair, Mr. Dwain McLean, received official written notice April 8, 2008, and stated that "This is encouraging news for the CKC and our community of judges. It will allow judges to continue unencumbered in accepting foreign judging assignments." 

Lifting the ban facilitates communication with FCI, allowing our organizations to move forward in relationship building. A Memorandum of Understanding (MOU) was presented to the FCI for consideration by CKC on January 11th and will form a cornerstone for future dealings between CKC and FCI member countries. The full correspondence received from Mr. Y. De Clercq, FCI Executive Director appears below.

 
Dear Mr. McLean,

 We have received your email sent to Mr. Muller.
The FCI General Committee indeed met last Tuesday and Wednesday and we are now able to report to you officially on the decision that was made.

The General Committee has decided to keep on cooperating with the Canadian Kennel Club in order to reach an agreement specifically as far as the "judge's issue" is concerned with a view to finally sign the MOU. Mr. Martinez (President of the FCI Section "Américas and Caribbean" and member of the FCI General Committee) will address this topic to the CKC in cooperation with the Executive Committee. While working together, the ban on the judges will be lifted, thus allowing CKC judges to judge at FCI CACIB shows. These judges will be allowed to judge, strictly and exclusively, the breeds which are recognized by the CKC and for which they have a CKC judging license. All of this with immediate effect and within a time frame until December 2008. The FCI website will be adjusted this week and the FCI members will be officially notified.

CANADIAN TRANSPORT RULING SUPPORTS CHALLENGE TO AIR CANADA POLICY

OTTAWA, April 4 /CNW Telbec/ - The Canadian Transportation Agency has disallowed Air Canada's proposed tariff revisions which would have terminated the carriage of animals and their kennels weighing less than 70 lbs as checked baggage on both domestic and international flights.
 
In its Decision No. 155-C-A-2008, the Agency found that the proposed revisions were unreasonable since an imbalance existed between the interests of Air Canada and consumers by giving only advantages to the carrier while exposing pet owners to many significant disadvantages.
   
Air Canada has until May 5, 2008, to amend its domestic tariff to allow for the carriage of animals and their kennels weighing less than 70 lbs as checked baggage. As for international flights, the Agency had already suspended, in July 2007, the carrier's proposed revision, and is now confirming its disallowance.
 
The Canadian Transportation Agency is an independent quasi-judicial tribunal which operates like a court. It regulates various modes of transportation under Government of Canada jurisdiction, including air, marine and rail. Its decision-making process is governed by the rules of fairness and natural justice to ensure that all parties in a complaint receive equitable treatment.

Responsible Dog Ownership Committee

 

The Committee met by conference call on December 6, 2007.  Present were Cathy Prothro, John Hodgkinson, Margaret Jones, Lee Steeves and Sonny Allinson. 

 

Updates were provided of areas across Canada that have been facing BSL challenges and/or new Municipal dog by-laws that could adversely impact the dog fancy.  Included were Halifax where a new by-law has been effected.  The local CKC Director spoke to Council at first reading and was asked for input to the by-law.  As a result of that input, moderation of several areas occurred.  BSL was not included in Halifax. 

In Ontario, two municipalities have been considering mandatory spay/neuter by laws.  These changes are cropping up across the country and now, more than ever, it is critical that members maintain a vigilant watch on their councils, bringing information and pressure to bear as necessary to ensure that legislation is effected knowledgeably and with an understanding of the impact on the Fancy.  In the West, spay/neuter is being proposed to some municipalities by local citizens.  The basic concerns began with roaming cats but broadened to all domestic pets.  Mr. Allinson has continued to write letters to councils supporting the CKC’s position that mandatory spay neuter is not in the best interest of responsible dog ownership and that BSL does not work.  The CKC Director for BC South west has been actively involved in pushing back against the by laws in areas including Saanich.  If members are facing restrictions such as these, the CKC has had significant success in dealing with municipalities and will support members who approach us for help.  Members should contact their local Director. 

 

Banned Aide Coalition legal challenge to DOLA – Cathy Prothro reports that the appeal will be filed by Mr. Ruby’s office during the winter of 2008.  It is unlikely that there will be a ruling from the Court of Appeal before the end of 2008.  The Coalition is currently almost out of funds and is in need of support from the dog fancy.  Costs are mounting as the factum is developed and the appeal goes forward. 

 

Of note internationally is the fact that Sweden has brought in excellent legislation in the area of dog ownership.  The legislation targets dog owners rather than dogs. 

 

Responsible Dog Ownership Project – Presentation packages are in the final stages of preparation for all three 2007 modules.  A communication plan will be developed by the consultant and a full presentation will be available to the Board at the March meeting.  2008 will bring the second of the three groupings of topics. 

 

Agreement was reached that there would be a web based “hot spot” listing that will highlight pressures on dog ownership anywhere in the country.  This would be the area where members bring to our attention local or regional by law issues.  

 

Committee Mandate – as this Committee has grown from strictly BSL to Responsible Dog Ownership, there was a sense that a mandate needed to be developed to ensure the Board and the Committee have the same understanding of its’ functions.  Mr. Hodgkinson offered to undertake this task and a copy of the proposed mandate is attached.

Mrs. Jones offered a public note of appreciation to Mr. Allinson for his excellent support in managing and providing the CKC position to the Saanich proposal for mandatory spay/neuter.

 

Mr. Allinson will develop and circulate a letter that is targeted to Clubs requesting support for the DOLA legal challenge by Banned Aide. 

 

Mr. Allinson will order the Ipsos-Reid poll recently conducted and targeting Canadian municipalities and that relates to BSL.

At the December meeting of the CKC Board of Directors, the Board directed that the Chair communicate with the Executive Committee of the FCI and with the presiding officers of national kennel clubs in all FCI member countries, to present the position of the CKC with respect to the continued application of sanctions against CKC-licensed judges.
 
CKC Foundation Seeks Board Members
50 Years 
The Canadian Kennel Club Foundation has been incorporated under the Canada Corporations Act and as a result, plans are underway to hold the first official meeting in 2008.
 
The Foundation is looking for individuals who are interested in serving as a member of the Foundation's Board of Directors.
